1. General Information

These Terms and Conditions ("Terms") govern the use of the online store at daospureherbs.eu ("Website") and all purchases made through it.

By placing an order on the Website, you agree to be bound by these Terms. Please read them carefully before making a purchase.

2. Products

Daos's Pure Herbs offers handcrafted, artisanal products. All products are made using natural ingredients.

Product descriptions, images, and prices are provided with reasonable accuracy. We reserve the right to correct any errors. Colours may vary slightly due to screen settings.

3. Prices and Payment

Prices on the Website can be displayed in Euros (EUR) or Romanian lei (RON), depending on the currency you select. Payment is always charged in Euros (EUR). Prices shown in RON are converted from EUR at the exchange rate published by the National Bank of Romania (BNR), updated every working day, and are for information only. Prices include applicable taxes where required.

As Soare M.N.B. I.I. is not registered for VAT (non-VAT payer), no VAT is charged separately on invoices.

Payment is processed securely through Stripe. You can pay by credit or debit card (such as Visa, Mastercard or American Express) and, where your device, browser or location supports them, by Apple Pay, Link, Bancontact or EPS. Your payment information is handled directly by Stripe and is never stored on our servers.

4. Orders and Contract Formation

Placing an order on the Website constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email.

We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, pricing errors, or suspected fraudulent activity.

To place an order, you add the products to the cart, go to checkout and enter the details requested at each step, review the order summary, accept these Terms and confirm the order, then pay. Until you confirm the order, you can go back to any previous step to correct the details you entered, and you can change the products and quantities in the cart.

After you place the order, we keep it in our system and send you its details by email; if you have an account, you can also see your orders in your account. The contract can be concluded in English or Romanian, in the language of the website version you use. The Romanian version of these Terms and of the contractual information is always available on the website.

5. Delivery and Shipping

We ship to countries within the European Union. Shipping costs and estimated delivery times are displayed at checkout before you confirm your order.

Risk of loss of or damage to the products passes to you when you, or a third party indicated by you other than the carrier, acquire physical possession of the products. However, if you commissioned the carrier to carry the products and that choice was not offered by us, the risk passes to you upon delivery of the products to that carrier, without prejudice to your rights against the carrier.

6. Right of Withdrawal

Under EU Directive 2011/83/EU, you have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.

Many of our products are handcrafted cosmetic and hygiene items, such as soaps and balms. If such a product is delivered sealed and you unseal it after delivery, you lose the right of withdrawal for it, as it is not suitable for return due to health protection or hygiene reasons (Article 16(e) of Directive 2011/83/EU and Article 16(1)(e) of Romanian Government Emergency Ordinance No. 34/2014). This exception does not apply to our other products, such as wooden boxes, nor to cosmetic and hygiene products delivered without a seal.

You exercise the right of withdrawal by informing us of your decision before the withdrawal period expires, by any unequivocal statement (for example by email), or online, through our withdrawal function (Withdraw from contract here). Please see our Returns Policy for full details.

8. Warranty and Liability

All products are subject to the legal warranty of conformity under Romanian and EU consumer protection law. If a product is defective or does not conform to the description, you have the right to a remedy (repair, replacement, or refund) within 2 years of delivery.

Our liability is limited to the purchase price of the product. We are not liable for indirect or consequential damages, except where required by mandatory law.

9. Intellectual Property

All content on the Website — including text, images, logos, product designs, and branding — is the property of Daos's Pure Herbs or its licensors and is protected by intellectual property laws. Reproduction without written consent is prohibited.

10. Privacy and Data Protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and Romanian data protection law. For full details, please read our Privacy Policy.

11. Cookies

The Website uses only cookies that are strictly necessary for it to work. We do not use analytics or marketing cookies. Details are in section 7 of our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Romania.

In case of a dispute, we encourage you to contact us first to seek an amicable resolution. If no agreement can be reached, disputes will be submitted to the competent courts in Bucharest, Romania.

As an EU consumer, you also have access to information about consumer redress and alternative dispute resolution bodies via the European Commission's Consumer Redress portal at consumer-redress.ec.europa.eu. (The previous EU Online Dispute Resolution platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228.)

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes become effective when published on the Website. Continued use of the Website after changes constitutes acceptance of the updated Terms.
